　問題となったのは方法クレーム3及び記録媒体のクレーム2である。

　方法クレーム3の内容は以下のとおり[1]。

3.インターネットを介したクレジットカード取引の有効性を認証する方法において、

a)クレジットカード取引と一致するインターネットアドレスを利用する他の取引についての情報を取得するステップと、

b)前記他の取引に基づき、クレジットカード番号マップを構成するステップと、

c)クレジットカード取引が有効であるか否かを決定するためにクレジットカード番号マップを利用するステップと

　を備えることを特徴とする認証方法。

　クレーム2は所謂ボールガードクレーム(Beauregard claim)形式である。これは、Beauregard 事件[2]以降に名付けられ、コンピュータに特定の処理を実行させるプログラム命令を含むコンピュータ読み取り可能な記録媒体(例えば、ディスク、ハードドライブ、その他のデータ記憶装置)とするクレームである。クレーム2[3]は長文であるが、方法クレーム3の方法を実行するプログラム命令を含むコンピュータ読み取り可能な記録媒体以上のものではない。クレーム2の概要は以下のとおりである。

2.インターネットを通じた顧客、業者間のクレジットカード取引における詐欺を検出するためのプログラム命令を含むコンピュータ読み取り可能な記録媒体において、

コンピュータシステムの一または複数のプロセッサによる前記プログラム命令の実行により、一または複数のプロセッサに以下のステップを実行させる；

a)クレジットカード取引と一致するインターネットアドレスを利用する他の取引についての情報を取得するステップと、

b)前記他の取引に基づき、クレジットカード番号マップを構成するステップと、

c)クレジットカード取引が有効であるか否かを決定するためにクレジットカード番号マップを利用するステップ。

(2)訴訟の経緯

　原告はRetail Decisions, Inc.(以下、被告)に対し、154特許を侵害するとして、2004年8月11日訴訟を提起した。被告は154特許に対し、再審査請求を行い、地裁はUSPTOの審査が完了するまで審理手続を中断した。その後、2008年10月30日、Bilski事件において、CAFCは大法廷判決[4]を下したことから、被告は米国特許法第101条に基づく無効を主張した。

　地裁は、被告の主張を認め、クレーム2及び3は保護適格性を有さないと判断した。被告はこれを不服として、2009年に控訴した。ただし、Bilski事件が最高裁に上告されたため、2010年10月28日に最高裁判決[5]が下されるまで、CAFCによる審理が中断された。

３．CAFCでの争点

争点：方法クレーム3が保護適格性を有するか否か、方法クレーム3の各ステップを含む記録媒体クレーム2が保護適格性を有するか否か

　クレーム3はインターネットを介したクレジットカード取引の有効性を認証する方法を権利化している。クレーム2はクレーム3と同一の方法を実行するプログラム命令を有するコンピュータでの読み取りが可能な記録媒体を権利化している。Bilski最高裁判決後、このようなクレームが米国特許法第101条の要件を具備するか否かが問題となった。

[1] 3. A method for verifying the validity of a credit card transaction over the Internet comprising the steps of:

a)obtaining information about other transactions that have utilized an Internet address that is identified with the [ ] credit card transaction;

b)constructing a map of credit card numbers based upon the other transactions and;

c)utilizing the map of credit card numbers to determine if the credit card transaction is valid.

[3] 2. A computer readable medium containing program instructions for detecting fraud in a credit card transaction between a consumer and a merchant over the Internet, wherein execution of the program instructions by one or more processors of a computer system causes the one or more processors to carry out the steps of:

a)obtaining credit card information relating to the transactions from the consumer; and

b)verifying the credit card information based upon values of plurality of parameters, in combination with information that identifies the consumer, and that may provide an indication whether the credit card transaction is fraudulent,

wherein each value among the plurality of parameters is weighted in the verifying step according to an importance, as determined by the merchant, of that value to the credit card transaction, so as to provide the merchant with a quantifiable indication of whether the credit card transaction is fraudulent,

wherein execution of the program instructions by one or more processors of a computer system causes that one or more processors to carry out the further steps of;

[a] obtaining information about other transactions that have utilized an Internet address that is identified with the credit card transaction;

[b] constructing a map of credit card numbers based upon the other transactions; and

[c] utilizing the map of credit card numbers to determine if the credit card transaction is valid.
